These are the Terms and Conditions for orders placed with ATC

PAYMENT TERMS:

The Deposit for Standard and Enclosed shipments may be paid by Cashier's Check, Money Order or Credit Card. Your credit card will be charged when we have contracted with a carrier to transport your vehicle. If the deposit is paid by Cashier's Check or Money Order this must be received by ATC within 7 days of the order being placed or by the time the vehicle is picked up by the carrier, whichever comes first.

The balance due is paid C.O.D. (cash, cashier's check or money order) directly to the carrier upon the delivery of your vehicle. If it becomes necessary for ATC Shipping to pay the carrier for the customer using the customer's credit card a 3% service fee will be assessed on the transaction total.

Should delivery be attempted after notification (3 to 24 hours voice notification to phone numbers provided by shipper) and shipper or his agent does not have proper funds or is unavailable to receive the vehicle(s) may be taken to and left at the nearest terminal or storage facility at the discretion of the carrier. The shipper will be responsible to retrieve and pay for any storage or redelivery fees.

Deliveries in Washington State. Any orders delivered in Washington State that ATC pays the carrier the total transport costs directly for the customer are subject to state and local sales tax on the total amount of the transport.

GENERAL TERMS:

1. The term "shipper" refers to the legal owner(s) of the vehicle or the person duly authorized by the legal owner(s) to enter into the agreement of the transportation of the vehicle.

2. Auto Transport Connection will be referred to as "ATC".

3. The term "carrier" refers to the company or person(s) who physically transport the vehicle.

4. PICKUP/DELIVERY. Normal pick up time frames are contingent upon service level. All dates that are given are an approximation. We cannot guarantee exact dates when your vehicle(s) will be picked up or delivered. There are many factors that affect the pick-up and delivery dates. The shipper understands that any transport may be delayed due to mechanical failure, adverse weather or road conditions, driver illness, supply and demand for trucks, drivers, etc. Most carriers cannot or will not guarantee pickup or delivery on a specified date. ATC under no circumstances guarantees anything other than best efforts regarding pickup and/or delivery as to a specified date.

5. VEHICLE INSPECTION. There should be a pick-up and delivery inspection done by both the carrier and yourself or the person responsible for the vehicle. The carrier will have a Bill of Lading/Inspection sheet that they will have you sign. At this time you should do the inspection along with the carrier. No one is responsible for damages not noted on a poorly reviewed delivery receipt. Make sure to inspect the vehicle carefully and review the inspection sheet to avoid an issue.

6. This order is subject to all terms and conditions of the carrier's Straight Bill of Lading/Inspection sheet. A copy of the Bill of Lading is usually available from the carrier.

7. The carrier's responsibility normally begins when the shipper or his agent signs the Bill of Lading at pickup and terminates when the shipper or his agent signs the Bill of Lading at delivery. ATC must be notified should the shipper be unavailable for pickup or delivery. The shipper must designate an agent at that time. If a carrier is sent out and the vehicle cannot be picked up there may be an additional $100.00 rescheduling fee charged to compensate the carrier for his time and expense.

8. INSURANCE. The Carrier transporting the vehicle(s) is normally fully insured. The carrier is responsible for the vehicle(s) while the vehicle(s) is in their possession. ATC is not responsible for any damage done to the vehicle(s). Any insurance claims should be filed with the carriers insurance. Usually carrier insurance does not cover any "Act of God" damages. Each claim case is different and should be taken care of with the carriers insurance. Please contact ATC in the event of any damage so we may assist in the event of a viable claim.

If damage should occur, all monies owed for transport must be paid to the carrier to initiate a claim. Damage must be noted in the proper place on the Bill of Lading and signed by the driver and the shipper regardless of weather or time of day. Signing the Bill of Lading without any notation of damage verifies that the shipper or his agent has received the said vehicle(s) in good condition. The shipper or his agent should check vehicle(s) thoroughly.

ATC is a licensed and bonded Auto Transport Broker. We are responsible for booking the shipment of cars with a licensed and insured Motor Carrier who handles their own damage claims. It may take a few weeks to process and resolve your claim since the drivers must return to their terminals with the original Bill of Lading conditions report.

9. The carrier and ATC must also be notified of any damage by phone or email with 24 hours. The shipper MUST submit in writing a description of the damages, clear pictures and 2 estimates within 10 days of receipt of the vehicle for any resolution to be initiated. ATC will support you in this effort should such a problem occur but in no way will ATC accept responsibility for any negligence of the assigned carrier. If your vehicle(s) is valued at a higher than market rate, we suggest you purchase a special insurance rider.

10. ATC or its agents will not be responsible for vandalism, acts of God (fire, floods, hail, sand storm, tornadoes or earthquakes) or objects flying from the road or sky during transport. It is also understood that the shipper and the carrier will enter into a separate contract between themselves. ATC is not a guarantor or a party to that contract. ATC is not responsible for the deliberate or negligent actions of the carrier. The shipper must look to the carrier alone for any redress. Shippers should maintain their own insurance for these reasons.

11. NON-OPERATIONAL VEHICLES. A $150.00 "NON-OP" fee is applied to all vehicles that are non-operational. This fee is included in the price when the non-running vehicle indicator has been selected. The shipper may be required to help load and unload the vehicle at the discretion of the driver. If by any chance, the vehicle is non-operational at the time of pick-up and was not first specified, or becomes non-operational during transport, additional fees may be applied.

12. Prices vary depending on the type of vehicle(s). Upon the pick-up of the vehicle(s), if the type of vehicle(s) does not match the vehicle(s) specified in your booking additional fees will be applied. Please confirm selections made carefully.

13. ATC does not guarantee transport by any specific driver/carrier.

14. ATC only arranges transport within the Continental United States or to a Broker and/or Vessel Carrier, designated by the shipper, at a Port of Entry. Once the vehicle(s) is delivered to the Port of Entry it becomes the responsibility of the designated Broker and/or Vessel Carrier at the Port of Entry. Any delays in shipping become the sole responsibility of the overseas Broker/Carrier.

15. The transportation of your vehicle(s) is door to door. Typically, carriers will call 8 to 12 hours before they are able to pick-up your vehicle(s). At this time they will arrange the exact location where the vehicle(s) will be picked-up and delivered. The vehicle(s) will be driven on and off the transporter or to and from the transporter at the pickup and delivery site. Should the carrier be unable to access either site the carrier will arrange with the shipper to meet at another designated location (gas station, grocery store, etc.). It is the shipper's responsibility to make a reasonable effort to meet the carrier at a suitable predetermined location.

If the vehicle(s) is not present at the time the carrier is scheduled to pick-up the vehicle(s) the deposit will not be refunded and will be given to the carrier. At the time that the vehicle is delivered if the appropriate person is not present to pick-up the vehicle(s), the vehicle(s) will be stored at the owner's expense until a time it can be secured for pick up by the shipper or their agent.

16. The shipper is responsible for preparing their vehicle(s) for transport. All loose parts, fragile or protruding accessories, low hanging spoilers, fog lights, antennas, etc must be removed and/or properly secured. The carriers are not responsible for any items or parts falling off of your vehicle during the transportation. Any part that falls off in transit is the shipper's responsibility including damages done by said part to any and all vehicles involved. The vehicle(s) should be shipped with at least 1/8 but no more than 1/4 tank of fuel.

17. ATC does not authorize the shipper to transport personal or household items in the passenger or trunk compartment of the vehicle(s). Load weight limits are placed on all carriers transporting vehicles and household goods. The carriers are subject to fines if they are over their load weight limit or they are not licensed to transport household goods.

If the vehicle(s) has been loaded with personal items the carrier has the right to refuse to load your vehicle, ask you to remove the items or they may charge extra (a much as $250). ATC and the carrier are not responsible for any personal goods placed in the vehicle. We do not recommend putting items of value in the vehicle. YOU DO SO AT YOUR OWN RISK! Personal items are NOT covered by the carrier's liability insurance.

The following items are not to be in the vehicle(s) at time of shipment: explosives, guns, ammunition, flammable products, narcotics, nuclear weapons, negotiable and legal papers, alcoholic beverages, jewelry, furs, money, other articles of unusual value, live pets, plants or contraband.

18. By submitting your order online, sending us your order by fax or by email, ATC understands you are placing your order and accepting the terms and conditions (in lieu of your signature) found here and on ATC's website. The shipper warrants that he/she is the registered legal owner of the vehicle, or that he/she has been duly authorized by the legal owners to enter into an agreement for transportation of the vehicle.

19. If you place an order with us you have the option to cancel any time prior to your vehicle being assigned to a transport. All cancellations must be made in writing. Once a carrier has been assigned for pick-up and transport of the vehicle(s), cancellation must be received by ATC 48 hours in advance of the scheduled pickup date. You will be charged a $50.00 Administration fee and the remainder of your scheduling fee will be refunded.

If the carrier has been sent out and the order has not been cancelled the remainder of the deposit will no longer be refundable and will be given to the carrier as compensation for their time and expense.

20. ATC will arrange for the transportation of your vehicle(s) by finding an appropriate carrier. We do not physically move your vehicle(s). Our services end when the Carrier assigned your order contacts you regarding pickup and subsequently delivers your vehicle(s). ATC is not responsible for rental car fees of any kind.

21. Resolution of any disputes shall be subject to the jurisdiction of the Superior Court of Whatcom County, Bellingham, Washington. Shipper specifically waives any right to claim jurisdiction of this matter at any other location. The prevailing party in any litigation initiated under this agreement shall be entitled to reasonable attorney fees and court costs incurred. ATC can only be liable up to the amount of the deposit located on your Order/Agreement. In no case can ATC be held liable for the designated carrier's damage. ATC will provide carriers insurance certificate and carrier information should any controversy arise.

22. The customer agrees that the information given to ATC Shipping is correct. Any information not provided about the vehicle that might affect the transportation will result in additional fees.
